BW Legal & G24 Ltd

Hey guys, 

Just looking for some quick advice, I've been browsing relevant posts on this and the newbies post.

As per advice given on this forum, I was told to ignore the letters from the "bailiffs" as they will contact the solicitors (BW Legal). I received letters from BW Legal about court proceedings for 3-4 months now & I've now received a letter of claim.

Do I continue to ignore as people on this forum told me G24 will never take proceedings to court due to their past experiences?

If there is any other advice I'd like to take it onboard.

commencement date was 20 Dec 2020.
Latest letter was dated 24/08/2020, stating I have till 24th September to pay the £160 fine or i will be issued with a CCJ lasting on my credit file for 6 years, and after that court proceedings with a total cost of it being £254 as they have listed their charges.

    It is not a fine, please read the newbies.

    They have also very likely have added an unlawful £60, please read this and complain to your MP.

    Excel v Wilkinson


    At the Bradford County Court, District Judge Claire Jackson (now HHJ Jackson, a Specialist Civil Circuit Judge) decided to hear a 'test case' a few months ago, where £60 had been added to a parking charge despite Judges up and down the country repeatedly disallowing that sum and warning parking firms not to waste court time with such spurious claims.   That case was Excel v Wilkinson: G4QZ465V, heard in July 2020 and leave to appeal was refused and that route was not pursued.  The Judge concluded that such claims are proceedings with 'an improper collateral purpose'.   This Judge - and others who have since copied her words and struck dozens of cases out in late 2020 and into 2021 - went into significant detail and concluded that parking operators (such as this Claimant) are seeking to circumvent CPR 27.14 as well as breaching the Consumer Rights Act 2015.   DJ Hickinbottom has recently struck more cases out in that court area, stating: ''I find that striking out this claim is the only appropriate manner in which the disapproval of the court can be shown''.

    You need to be following the guidance in the first few paragraphs of the second post in the NEWBIES thread to discover exactly how to deal with a Letter of Claim.

    In my opinion, you would be unwise to ignore a Letter of Claim.

    A CCJ cannot possibly precede a court judgment. A credit-affecting CCJ occurs following a judgment against you and if you fail to pay up by the deadline set by the court - normally 1 month, but can be shorter. 

    Are you sure they are threatening a CCJ before any court action?  Can we see a redacted scan of that letter?

    G24 have no past record of litigation, to our knowledge - we don't have intel on every single parking court case in the country, but we would have seen something for sure if they were active in this regard. 

    But we can't give guarantees on how a third party might act at some time in the future, especially as they have 6 years to pursue a legal case, and times are very hard for them at present given the restrictions placed on people (and vehicle) movement during the pandemic. Anecdotal evidence suggests that PPC revenue is down by as much as 80%.
