Petrol pump con!

Hello everyone 
I need some advise! I went to a local petrol pump to fill up, I picked up the nozzle and immediately realised that it was 95 octane, so I put it back and picked up the 97 octane and tried filling up, the pump did not start, I could see £10.02 on the counter and I thought it was from the previous customer (that was my mistake), after about 3 minutes waiting I reached the window and told the operator that pump isn’t starting- so he started my pump and I filled up..When I finished and got to the pay point they asked me to pay for the initial £10.02 which I denied, there was a lot of arguments and he said he checked the CCTV and I had filled up twice (which I know I didn’t), and made me pay for both the transactions..what are my rights?

    Obviously, you have the right not to pay for the petrol you didn't pump. But might be a bit late to argue about it now if you've already paid.

    I doubt there's much you can do about it now, other than to go back, politely complain and see if they'll refund you.  They presumably have CCTV evidence of you taking the pump twice.

    CCTV shows you putting the nozzle in then out then another in again, their screen shows two amounts, who do you think they are going to believe? The evidence is against you.

    Unless they have previous problems with phantom amounts randomly appearing on pumps then you are not getting anywhere.

    When you pull out the nozzle the amount on the screen resets but the counter still has a record of it until it's paid so unless someone stole a tenner's worth of petrol before you, you are the likely customer.
  • Did the pump not have the usual 'please ensure counter reads £0.00 before filling' sticker? 
    I always wait until it resets to zero before putting it near the car for this exact reason.

    Make a subject access request for the CCTV footage.

    Watch it carefully and note down exactly what it shows with precise timings. If, for example, there was not enough time for £10 worth of petrol to flow whilst the nozzle was in your car then you have some evidence in your favour.

    Write to them with your evidence and ask for a refund.

    How much petrol does your car hold.  If it is an impossibility that the two pumps together could even get into your tank then you need to ask the garage again to look at their cctv and what the previous customer who used that pump did.

    I fully agree - BUT I took the nozzle from the holder, and then put it back within few seconds, I didn’t even take it near my car - so that should be evident that I didn’t take any petrol? Right??

    In which case, you're onto going back to them to ask them to check the CCTV.

    Sounds like previous driver drove off. 
    Should really have refused to pay and let them call the police. CCTV would have been pretty clear if what you say is true.

    But going forward, never put nozzle near car till you see pump reset.
