Diesel claims

My late husband had a 2007 plate Peugeot diesel car. Can I claim against the manufacturer on behalf of his estate?

    2007 is the very earliest date involved in the claims and the car may have been manufactured before then.

    The main culprits are in the VW group whereas Peugeot has not yet been involved in any of the claims.

    There is a section in the MSE website covering this and in it they say that such companies may never be implicated and no claims or payouts would occur.

    Personally I think you are clutching at straws and will get no where with this but it's your choice if you wish to employ a claims agency to put your claim in. They will of course take a significant commission should you ever get compensation.

    The VW cheat device was designed to lower Nitrous Oxide emissions during testing for countries like the US which test for it and tax based on that. Cars in the UK are sold on CO2 emissions (as that is what VED is based on) and MPG, they are not sold on NOx. How were you mislead into buying a car? Do you have any evidence your husband bought the car because of NOx emissions or because of environmental concerns? Or more realistically, he bought a diesel for low car tax (which he got) and higher MPG (which you might have got depending on driving style) so he was not miss-sold.

    I think you should put in a claim.  He was benefiting from a lower rate of tax, based on the supposed lower emissions that the car was churning out.  Now it turns out that the car was actually emitting far more pollution than claimed, so you should repay HMRC the extra tax that you should have been paying each year, based on the actual emissions.

    What was his material loss?  Did you express this to you before he died as something he wanted you to persue?
