Gladstone Text Message

Hello,

I have received a text message from Gladstones solicitors saying the below;

 Due: £160 You have not responded to our Pre-Action letter. Please Visit XXX or Call 01565 755088 to avoid court action. Quote Ref: XXXX

After some googling I found the company while a sham outfit are indeed real. I have never received a letter so am clueless.

I may have made first mistake in calling them. I was on hold for 45+ mins before I eventually got through to a rude unhelpful member of staff. He asked for the Reference and I complied but refused to give my name. They refused to discuss without my name so I gave my name which they claimed matched there records. He asked for my address which I did want to give but it felt like the only way to find out what this is about. I simply gave the first line of my address and he said it was wrong. I then gave the first line of my 3 previous address (no towns or postcodes) and none matched what they have (about 10 years of address history).

I am concerned as I have no idea what this would be about and unsure as to what to do. The person on the phone said they will do an Experian check to find my address and send me a letter until then nothing else they can do or discuss. 

I do not actually own any of my vehicles they are leased meaning they would of never contacted me anyway and would go directly to the funder as they are the registered keepers. The vehicle I did own about 6 months ago was sold to a dealer and I have the DVLA change confirmation from the online application. This vehicle was registered at my current address as the most recent address on the V5C.

Any ideas on what I should do?

    Have you received any letter of claim or a N1 claim form from Northampton CCBC?  If not, I wouldn't worry.  As you say, mistake to call as you now have absolutely no proof of what was said during the call.  Wait for letter from Gladstones.

    No letters or anything received as of yet.

    I guess I just sit tight and see if anything comes from it. They do say calls are recorded but fat chance if I needed it!

    If it was in your favour it would have mysteriously disappeared due to a non-specific fault!

    You could send Gladrags an SAR as per the NEWBIES, requesting all your personal data they hold on you. That should flush out the identity of the PPC, so you can then send them an SAR as well to find out what it's about.

    Include proof of ID such as a copy of a V5C in your name, or two redacted utility bills, or redacted bank/card statements. Never send photo ID.

    At least £50 of that is unlawful, read this and complain to you MP.

    Excel v Wilkinson


    At the Bradford County Court, District Judge Claire Jackson (now HHJ Jackson, a Specialist Civil Circuit Judge) decided to hear a 'test case' a few months ago, where £60 had been added to a parking charge despite Judges up and down the country repeatedly disallowing that sum and warning parking firms not to waste court time with such spurious claims.   That case was Excel v Wilkinson: G4QZ465V, heard in July 2020 and leave to appeal was refused and that route was not pursued.  The Judge concluded that such claims are proceedings with 'an improper collateral purpose'.   This Judge - and others who have since copied her words and struck dozens of cases out in late 2020 and into 2021 - went into significant detail and concluded that parking operators (such as this Claimant) are seeking to circumvent CPR 27.14 as well as breaching the Consumer Rights Act 2015.   DJ Hickinbottom has recently struck more cases out in that court area, stating: ''I find that striking out this claim is the only appropriate manner in which the disapproval of the court can be shown''.

    You are talking about Gladstones who set up the IPC/IAS scam

    The problem with phone phishing is that they don't actuaaly know if the text has reached you, For all they know your phone is at the bottom of the river.

    The added £60 is dual recovery and is unlawful.  Read this and complain to your MP.   Judges hav ebee known to throw out entire cases brn.

    Ask the lease firms you deal with (or used to) if they gave an old address for you to a private parking firm.  Tell them it may have been months or even a year or more ago. 

    Ask for a copy of the PCN they were sent and tell them to rectify your data to the correct address if you still deal with that lease firm. 

    And email a SAR to Gladstones listing all your addresses for the past 6 years.
