Car hire special online offer non refundable

We have just returned from spain having prebooked a car hire with DoyouSpain.com. We booked the night before we flew to malaga and picked up the paperwork off the printer on the way. When we arrived in spain the goldcar desk refused to give us the car as we had paid using my debit card(which was also a joint account). We did not have a card with my husbands name on it who was the named driver. We asked if they could add me as a named driver or the main driver but the agent point blank said no and said we could complete an agreement for another car at the cost of 500 euros (more than double what we had already paid). I am now requesting a refund as we did not receive the goods which we had paid for. Do you Spain have said no as it was a special offer and non refundable. Do I have any rights to get a refund please?

Does the debit card have your husband's name on as well?In the game of chess you can never let your adversary see your pieces0

Their T&Cs are based on Spanish Law and so would need to find out what rights you may have for services (not goods - you dont get to keep the hire car) in these types of circumstances.
According to their site https://support.doyouspain.com/hc/en-gb/articles/360023500774-What-documents-do-I-need-to-take-to-collect-the-car- it clearly states the main driver will need a card in their name and therefore this appears to be purely your own fault especially when trying to cancel a time based service after the time of the service (ie company had no opportunity to resell the hire of the vehicle)

I don't think you have a right to a refund under the terms on their site.0

Ah good old Goldcar.
Unfortunately if you didn't meet the terms of the booking you have no claim for them not honouring it.0 -
Quite. Get themselves to the top of any search by lowest price, make their money through various punitive charges. A classic example of cheapness not being good value.visidigi said:Ah good old Goldcar.
