McClure Solicitors

Hi. I took advantage of the November free will last year and contacted the above. Started the process then decided to have an estate will plus lasting power of attorney which cost a lot more than the suggested donation. Long story short - lots of back and forward and things took ages to complete then out of the blue last week I got a letter confirming the will was finalised from a different solicitor. Yesterday a pack turns up - all of the POA paperwork with a letter saying McClure went into administration and the firm taking over have too many cases and cant deal with it so i have to file myself or find someone else. They have confirmed I cannot claim any recompense from them for funds lost re fees already paid to McClure. I am out of pocket by £900. Any advice? Is that money lost? Anybody else had this problem?

You may have a claim for compensation from the Compensation Fund run by the Solicitors Regulation Authority (sra.org.uk) as it appears you have paid for a service that you didn't receive.

Just discovered the firm was in Scotland, the advice above applies to England and Wales only, I would assume the Scottish Law Society will have a similar scheme but if you look at the website of McClures it says no money has been lost and is held in a client accounts, so I would suggest you start by following the advice there
  • Hi my dad is the same.
On the letter it states ‘ for the avoidance of doubt, we cannot provide recompense for the fee element of any sums you paid to McClure Solicitors ‘

I have no idea where we stand now. Trying to do some research but no clue where to start really.
The McClure website makes out as though all funds will be protected and safe … clearly not!!

    Are you any further forward,

    thanks Victoria

I think in both cases the money (at least the majority of it is lost). Any claim you have will be with the administrators of the firm, but you will just be one many unsecured creditors and at best will receive pennies in the pound.
