Example.
Asif decides to take his payments at the age of 60. The DM decides that Asif has not deferred payment of his occupational pension because he has taken the pension at the retirement age for the scheme
Inferring that taking payments later than the normal scheme retirement age is classed as deferral therefore would be included as notional income.

I do still wonder about the example at 1 SPC Regs, reg 18(1D), although it would have been a little more helpful what would happen if Azif had waited until he was 62 to claim his occupational pension.1 -
But the SPC Regs only deal with people who have reached pension age (now that pension and PC age are the same). The paragraph (H5170) in which the example occurs begins “A claimant who has reached qualifying age for SPC and has entitlement to an occupational pension but who has elected to defer payment ...”. It’s a very out of date example because it is now quite a few years since SPC age was 60.Information I post is for England unless otherwise stated. Some rules may be different in other parts of UK.1
