    The likely answer is yes. A claimant solicitor will always seek to identify the "other" insurer and pursue against them. If they are successful in their claim, they are far more likely to get their hands on the actual money from an insurance company than an individual. Enforcing a judgement against an individual is an uphill struggle.

    As a personal injury claim, they have 3 years to issue proceedings (and a further 4 months to serve them). In this case they are well within the statutory limitation period.

    As advised in previous posts, you've really done all you can now. We're all agreed - pass this on to your insurers and let them deal with it - you've paid them the premium, so let them get on with it!

    Part of the Furniture Combo Breaker
    Spoke to the old ins co last Monday. The claim was still 'open'. All that people said was correct ie that the other party's solicitors were registering their claim before the 3 year deadline expired. Anyway sent the paperwork to them recoreded delivery. Still slightly miffed that I wasn't kept in the picture, but they will deal with it and that's the main thing.
