If you agree to pay a fee, you have a moral duty to pay that fee. I know this is MSE, but this is not a site that advocates debt evasion, which in my mind this effectively is.
They will not be expected to read all the "small print" before parting with their cash. That is why you will see some companies making it very, very clear in bold or requiring the customer to tick a special box to confirm they have understood a particular, important and especially if unusual part of the terms and conditions.0 -
You might find it's just a matter of being patient. I did eventually get a refund for my cancelled flights, also booked through mytrip, but it took more than a year. This was after getting a chargeback from my bank, which was then reversed by mytrip! In the end I don't think anything I did helped, although I was emailing them regularly to chase up the refund. One day I just got an email asking for my payment details and then got the money about a week later, minus the £30 admin fee, which as others have said they do seem to be able to charge legally.0

Just an update, After performing a chargeback mytrip disputed it successfully, and it was reversed. Here was the email I got in October:You previously contacted us regarding a dispute you had with ETR.mytrip, under the MasterCard Rules we contacted ETR.mytrip via a Chargeback process and have now received a response.ETR.mytrip have challenged the claim as they believe the Chargeback to be invalid and have provided supporting evidence. After reviewing this evidence NewDay LTD are now unable to continue the Chargeback process and any credits you have previously received will be reversed.The decision to re-apply transactions to your account was due to;
- The merchants evidence confirms the booking was made via a third party and as they are not the supplier of the service they are not liable for any Chargebacks.
I have since then been emailing mytrip to chase my refund, they said it was being refunded, now today I received this:
With regard to your booking it shows that the charge back resolution is yet to be received from your bank and hence there is a delay in refund process.We advise you to contact your bank directly for more information.
This was reversed back in October, I am trying to contact New Day as they suggested, anyone have any ideas on how to proceed?

Were the individual flights more than £100? If yes, to court against NewDay under S75 CCA.
Were the individual flights less than £100? If yes, to court against MyTrip.
It's almost always easier to enforce a judgement against a bank than an OTA.💙💛 💔0 -
