Obtaining car insurance with ongoing claim

I have been involved in an accident. It was not my fault and the insurance is treating as no fault however they have not heard from other driver insurers. I know that she could turn around and not admit liability or dispute it although I hope she will not she was clearly at fault.
I've not been provided with a courtesy car as car was written off. I have seen a car I would like to buy and have done some online quotes for both non fault and at fault for the accident which are not too bad at all. I've been told an insurer could insure me but would treat my accident as at fault until claim settled and if other driver admitted liability it would be changed to non fault and I would be refunded any difference. Does anybody know how to do this - is it just a case of ringing the insurers direct or using a broker? Just wondered if anybody had been in the same position?

Just get a quote as normal. The online sites will ask if you have had any claims in the last 5 years, and you put in there is an ongoing claim. It will be on their database. Alternative is to stick with current insurer for the new car if their quote is competitive.1

Can you not transfer the remainder of your existing policy onto the new vehicle which therefore avoids the question for now and gives your insurers more time to resolve liability before you have to answer the Q again.
Most insurers will treat any open claim as a fault claim because of the uncertainty involved in any claim until the money is in the bank0
