BMW safety iSSUE

I have 64 Number plate BMW X3 and gave to bmw dealer for a full service before a long drive to Scotland. The next day after the service I was driving the  car for a short shopping trip and brake pedal suddenly  stopped functioning fully. I was scared and stopped the car for a check to see the issue. I was shocked to see a steel road or a big pin came out from the breaking pedal system.

I have taken a recovery truck to deliver the car to service center and stilll awaiting for a fix for the same. However , bmw service team is not ready to take the responsibility as they said that they don’t normally open the part from where the pin came out. 

Since it was a major safety issue which would have caused a huge incident for my family , i would like to know the options to get bmw and my dealer to take the responsibility of this issue. This is a well maintained car with full service history and no other past issues.

any guidance will be much appreciated

    How do you want them to take responsibility? A service via a main dealer is a set series of things they need to do which is very much finite in nature and doesn't involve stripping the car to check each and very component, connector etc.

    Sometimes coincidences happen and the 2 events are not connected. I can't see any reason why they'd be working on the brake pedal for a service
    Remember the saying: if it looks too good to be true it almost certainly is.

    What do you want them to do?
    Even if it was the garage's fault (which doesn't seem to be the case), all you could reasonably expect is a fix and an apology.

    It is highly unlikely that the BMW agent is responsible and a Google of X3 brakes doesn't throw up any issues.

    That said, manufacturer's do have a responsibility for safety critical failures for the lifetime of the vehicle which is why there are safety critical recalls well beyond the warranty period. It's not you or I who decide whether it's safety critical but you can have a read on this link to see what to do.

    What you have described is not a general service item.

    It sounds like an unfortunate coincidence.

    As the car is well out of manufacturer warranty all you can ask for is an investigation and if they can ascertain it was a manufacturing issue you may get it fixed for free.

    You will, of course, have to use a BMW dealer and not a third party garage.

    Ultimately it's a 7 year old car, you may get a good will gesture. Have you googled to see if it's a known fault ?

    The only 100% safe car is one you are not in.

    Yes you can't expect a 7 year old car to have brakes that work.

    Fred, that's not the issue.  It's all down to what caused the failure.  It's easy to assume it's due to the service, but if the brakes have nothing to do with the service schedule at that point, then it won't have been the technicians/mechanics that did the service.
  • The failure was in the brake pedal mechanism, which is not a normal service item.

    I can think of very few reasons why work would be done in that area, possibly a brake light switch replacement.

    @ngeorgethomas1, did the garage actually do any work in that area during the service ?
