    Yes this is always the most likely possibility, but in that case does the 3rd parties insurance company have no liability at all?

    Only if the driver is identified... doesn't matter who the driver is, named on the policy or not, driving with permission or stolen. Whilst the driver remains unknown there is no liability to the vehicle insurer.
