    I don't see what your mental state has to do with this if your claim is you accidentally booked the hotel.  It was an accident that could happen regardless of mental state.  Is it really that easy to accidentally book a hotel using their app?  Even with payment details loaded there are typically several hoops to jump through before you get to the final page where you can book.

    Either way, it's not cut and dried as to whether being drunk means you can or can't form a contract, otherwise nobody would have anything to do with anyone who is drunk because they could just say "I was drunk" to get out of paying.  And as I said your argument appears to be the app makes it easy to accidentally book a hotel, not that you were drunk and lacked the capacity.

    FWIW you do have a night away to show for it, your booking is in Spetember.
    Unfortunately I don't because I cancelled before I realised it was non refundable

    Your best bet is probably ringing the hotel up and explaining. They might still honour the booking if it hasn't been resold. 
  • Just an update I never posted - I contacted the hotel direct who said they couldn't refund as the money was with Hotels.com and Hotels.com were telling me it was up to the hotel to refund so I screenshotted the emails and took a chance of raising a case with PayPal and (love them) they refunded my money! PHEWF

    I'd expect an LBA or debt collector to start chasing the debt before long then.
  • PayPal refunding you doesn't mean the contract has been cancelled.  Best cross your fingers and pray they don't come after you.  If they do time to man up and pay it.

    You'll either get debt collectors on your case, or next time you book with them they'll take the money to cover the old booking. 
    There's absolutely nothing to stop Hotels chasing the money, and they likely will once they realise what's happened.
