  • I'm not at home at the moment and I can't remember the judges name off the top of my head but it was Bristol County Court. Gladstones had apparently notified the judge that they wouldn't be present so it was just me and the judge on the phone. He went pretty much straight to his judgement, said that considering the evidence submitted by both parties in our W/S it was clear that the claimant had sent notice to keeper too late which was his main reason for dismissal. He also mentioned signage, saying that he would expect to see a lot of photographic evidence from the claimant as proof which they had not provided and said he could see the photos taken by me showed an obvious lack of clear and legible signs. He asked if I had anything to add which I didn't, at this point I would have been happy just with dismissal but he moved on to my schedule of costs and asked if I'd had to miss a day of work for the hearing, I told him I had and he said he would award the £95. He also said in regards to the further costs I had added for research and preparation etc he would add those if he could but said that in the small claims track, judges cannot make one party pay another's costs ¯\_(ツ)_/¯. Then he asked if I had anything else to add, I didn't, so that was that. All in all was on the phone for about 15 minutes.

    I'll send over the name of the judge once I get home.

    Thanks for the court report. I'm sure it will help others who have to prepare a defence for this location.
