LBCC Received - Not Sure Whether to Pay

So i must admit I didn't follow the steps posted in the newbies thread when i got the PCN in 2017.

I have a fine from LPS (local parking security) for parking without a valid pass. It was a pub carpark and the pass in the windshield had expired. I didn't appeal it at the time and have just ignored it and the debt collecting letters until now. There was a PCN notice on the windshield and I receieved an NTK on day 89 after the charge.

This is being handled by Gladstones who've sent me (registered keeper) a Letter Before County Cort claim. I requested a Subject Access Request and they sent photos of my car, the invalid pass, the parking ticket and some signage (though the signage was quite abstract and no idea where it was in relation to my car). 
I responded to the LBCC online querying if the NTK was even valid as it was received 3 months later and this is the response:

Our Client has evidence of a parking charge notice (Notice to Driver) being affixed to the vehicle windscreen at the time it was issued. As the charge remained unpaid and there was no successful appeal to the parking charge notice, our Client applied to the DVLA for the Registered Keeper details and were given your details.

A Notice to Keeper (Reminder Notice) was subsequently sent to you in accordance with Schedule 4 paragraph 8 of the Protection of Freedoms Act 2012 ('the Act') giving you an opportunity to pay or nominate the driver.

Our Client will aver that you were the driver as this presumption has not been rebutted. However if you weren't pursues you as the Keeper (see the Act Schedule 4 (4) (1)).

If you nominate the driver by providing us with their full name and address prior to a claim being issued our Client will pursue them, not you.


I've received a final letter asking for payment within 14 days. The fine is now £145. I don't really want to go to court to argue this out, I know they are cowboys but im considering making a gesture to pay some of the fine.  Any help would be much appreciated

    Of course you do not pay, It is not a fine it is a scam, please read the newbies and complain to your MP

    Why do you need a permit to park at a publ?  Have you seen this?

    I assume that your SAR was emailed to the DPO at LPS ??  Not to Gladstone's ?

    14 days notice is not an LBC , it's a debt collector letter

    I have never heard of any parking company allowing a lower payment

    It is not a fine , it's an invoice
