Late delivery

On 27/06/21 I ordered 3 items from shabby store. A set of boxes and 2 glass jars.
the boxes and 1 jar were preorder for July delivery. The second glass jar did not stipulate preorder and as such I expected delivery in their 5-10 days. Delivery is paid for by the customer. The jars are a 50th birthday gift for my mum on august 1.

I contacted the store on 29/07/21 to cancel the jars as they clearly weren’t going to arrive in July or in time and it had been 32 days at that point since I placed the order.
They told me I was only entitled to a credit note as per their T&C’s which I found really strange.

They went on to say the jars are pre order for august which is what they are currently advertised on their website as but this wasn’t the case when I purchased them, regardless one of the jars wasn’t a pre order item (I have proof of this in the confirmation email) so that should have been sent to me as per normal delivery timescales. It also shows they don’t even have the stock as the jars are pre order for august.
I was happy to wait for the boxes as there is no rush but the jars were essential.

I received no correspondence from them until I made contact yesterday.

They are being very resistant int heir emails to issue a refund, and by resistant I mean not acknowledging my evidence or legislation, and saying as little as possible.
I have quoted the consumer rights legislation surrounding delivery timescales and that I’m entitled to a refund. Is there anything else you can suggest?

The issue with late delivery sounds like one that's of your own creation unfortunately - it sounds like you only paid one lot of delivery charges, so can't expect two separate deliveries.
If the in stock item was time critical you'd need to order this separately to the rest so 2 delivery charges are collected - one for the in stock item to be sent immediately and the other for the out-of-stock item.0 -
their terms and conditions are not legal as they say you have 5 days to tell them you want to return the goods.
They say if a chargeback is made the goods will remain their property. That makes me think they get a lot of chargebacks.
Personally, if you paid by debit/ credit card I would start a chargeback claim with the card provider and forget the whole order.
