PPI claim / bankruptcy

I need some advice please. I applied for a PPI claim via an agent. NatWest came back and awarded around £800 but because I have been bankrupt many years ago I did not receive any of the money. The agent is trying to make me give them £197. I explained the situation and now they have passed this to a debt collection agent who now say it is pending legal action.

Do I have any right as I did not receive any money from NatWest?

Any advice would be appreciated

    It depends.

If you had arrears, defaults, amounts written off, IVAs or Bankruptcy then you should never use a claims company.  They are entitled to bill you for the redress paid even if you do not get it personally.

However, if they knew you were a bankrupt then they should have warned you about this before getting you to agree to the contract.   Did you tell them this information?

  • Well, if you'rve been bankrupt then you're not entitled to any PPI refund - its usually an asset to your bankruptcy. So, it should be paid to the entity managing your insolvency (eg Official Reciever for bankruptcy in England & Wales). Even if you've been discharged.

BUT i don't believe it stops that agent charging you for their service.

Totally scummy, but if you signed up to their contract of service and fees, i don't know what you can do... :(
