What would be the appropriate HMRC form?

Hello I am trying to resolve my late mother's estate, my two siblings were granted LOA but failed to bring matters to a close and they have died without leaving a will. I have a copy of the grant of probate given to them which states that no IHT applies so no tax paper work was needed. I am trying to bring things to a completion, without a solicitor as far as possible,  and have sent a copy to the probate registry asking for advice but have been told to fill a IHT form in any case! ; they have not specified which one.
Is there anyone who can point me in the right direction? Appreciate your advice. Thank you in advance.

I'm not sure I understand this, but I wonder if what you need to do is apply for Letters of Administration for your two siblings, unless someone else has already done that. The point being that you have the grant of probate for your mother, but you have to demonstrate your right to use it, and I am not sure that your siblings' death certificates would be enough for that.

What remains to be resolved? A house to sell? bank accounts? Are you clear about who inherits both your mother's and your siblings' estates?

I am sorry for your losses.

Thank you Savvy_Sue. I don't need to apply for the two siblings who have died I believe their children are dealing / or have dealt with that. All they are interested in is to have their share of the asset, mainly my mother's house. At the time of her death all siblings were alive. So the share will be divided amongst the surviving siblings and  the children of the siblings who have died.
My late mother's bank accounts funds , small amounts, have been depleted by the then administrator.
The chain of execution for administering the remaining estate has been broken and it is this matter I wish to bring to a close.

Did the siblings who died have executors? If not, your mother's estate will be distributed by whoever administers your deceased sibling's estate.
If you've have not made a mistake, you've made nothing

So it sounds as if responsibility for bringing this to a close doesn't rest with you at all. You may need to point this out to your nephews and nieces - while offering to help if they need it, dealing with their grandmother's estate passes to them.

The siblings who have died did not leave a will. My understanding is that the children ( myself and my siblings) have first call to administer the estate before the grandchildren. In my case the grandchildren would prefer me to deal with the mess they are not interested in the intricacies of the protocols etc.. they just want their share! .
  • I am sorry to hear of your predicament. May I suggest that it would be best for you to make an appointment with your local Citizens Advice Bureau, who will more than likely be able to provide you with a copy of the form and help you to fill it in, all for free.
