GYM Membership Refund Help

Hey,

Looking for some advice. I signed up for a gym membership in May, paid 1 years membership in full, was advised my membership pack would be issued in post and I would get my online account set up & sent via email.

A Few days pass and nothing received (during which time I cannot access the gym) i phone them up and they ask me to come in, i go in & give them my details and they tell me that's things sorted and packs will be issued & emailed straight away. A few days pass and nothing again, numerous emails, and calls follow but still not sorted, I have then emailed them to advise i still haven't been given my pack and access to the gym and I wnow just want my money back. 

They have got back now advising they can't do that, and all I need to do is come in and see them again and they will get sorted (as it's an easy fix apparently, despite them not being able to do it in the last 2 months!)

Can anyone advise where I stand? I'm pretty sure they have lost my initial membership paperwork which is why they have been unable to resolve, which would mean they don't have a contract to hold me to, and why they want me to go back in so I can sign again. Given how inept they have been I just want my money back and will join somewhere else. Any advise on my rights would be appreciated. Just for info it is £750 i paid.

    Why haven't you been able to access the gym? Isn't it at the same location they've been asking you to visit?

    The lack of paperwork doesn't mean there isn't a contract, it just (might) make it more difficult to prove what the terms were. It's pretty obvious you signed up to something if they've got £750 from you.

    Because you need to book online through the online portal which is part of the membership pack I've not been issued and also require a fob (part of Membership pack) to scan in, which I've also not been issued. The gym is part of a hotel complex and in a different building to the location they've asked me to visit. 

    The terms of the contract were pretty clear, I pay £750 and they give me access to the gym, only 1 side who hasn't stuck to their part of the agreement, as I say I have visited them to resolve which they didn't, phoned and emailed countless times and still not resolved after 2months. 

    Hopefully that makes things a bit clearer and if anyone has any actual advise on how I sit in regards my consumer rights that would be much appreciated.
