Trouble with A shade greener panels

Hi all, trying to sell our house with solar panels (cheap bills only)  and we we were told by ASG that it was a simple matter of the new owners signing the lease.   Lo and behold, this was not the case. The vendor's solicitors require the paperwork for  matters of conveyance.   They never sent me any documentation other than a sleeve which only had a welcome letter. Now they want to charge me for a copy of something I have not received before.  They sent me the following email:

"Good Morning,

 

All documentation and certification were sent to the property upon installation of the solar panels.

The fee to provide duplicate documentation and additional legal services has introduced under ASGM’s company policy, which we are entitled to do, due to the unprecedented amount of requests that we receive from customers and solicitors for documents that have already been provided, and legal services that completely surpass any maintenance obligations set out in the lease agreement.

There is no legal obligation for the Tenant, A Shade Greener Limited (as installer) or A Shade Greener Maintenance Limited (as the O&M company) to provide documentation or legal services at all, free of charge or at cost.

ASG satisfied all of its obligations as an installer. Therefore, there is certainly no responsibility for ASGM to now to provide any duplicate documentation or legal services whatsoever.

If you do not wish to utilise the additional service that we offer then we will close our file on the matter."

It feels really unfair to be charged for some thing we have not received previously and it is adding extra stress on moving house.

On a positive note, I've not had some of the problems I've seen on these forums with ASG.

    The time to point out that they had not sent you the documentation was when you received the welcome letter only. When was that? Years ago, I presume.

    It is far from unreasonable for them to charge for issuing copies now. And, yes, the buyer will definitely require them...

    Remember, you have rented your roof out on a long contract to a company who have installed their solar panels on it. That contract transfers to the buyer, and their mortgage lender want to make sure no issues will arise from it.
  • Thank you, you make a fair point but it is unreasonable to charge £200 + for the amount of paperwork involved.

    I approached ASG over a month ago asking for the paperwork and advice and was informed by the legal department that I do not need the paperwork. It was a simple matter of signing over the lease. So to find out that the legal department now want to charge me for something that I was previously told I did not require does seem somewhat unreasonable. My welcome pack was  not addressed to me in person but to a prospective client. 
    So before you make your response it might be worth making sure  you know all the facts.
    ASG are making money off my roof space which is an obvious part of the contract.
    Raging against the machine I realise. 🥰🙂🤗

    They cannot speak for  what other companies/solicitors require.

    Indeed not. The buyers lender will want to see the lease and can subsequently refuse to lend depending on what it says. Some leases are particularly onerous regarding repairs, for example they won't allow the property owner to remove the panels if there is a problem with the roof and insist on controlling who js allowed to repair the panels. At great cost.  Not an issue when the panels are new but a problem later in the lease.
     I pulled out of a sale where panels were installed, the lease terms were unacceptable and to buy out the 20 Years remaining on the lease would have cost me 20k. It definitely is not a case of the buyer 'just signing the lease'
  • A SHADE Greener are greedy money grabbers, they sold the free solar panel system with very little information on the negative impact this would have on house sale value and the difficulties this has for re morgaging. Am fighting them at the moment they won't get a penny off the panels on my house or me. They twist the agreement to suit themselves by giving ridiculous long lead times for removing panels unless you pay for scaffolding and big deposit... They refer you to their legal team who want £250 every time they look at anything, I hope to get them to court for Miss Selling the free solar systems, or go bankrupt trying and that way the morgage company can have the panels removed in their favour
