Deed of variation for Rental charge

Hi all,
we are in the process of selling our house and hoping to exchange this week and I’ve just been made aware of a last outstanding enquiry from the buyer’s solicitors.
They are asking for us to obtain a Deed of Variation in the Title deeds to prevent the freehold being at risk, should the £1 a year rental charge not be paid. The rental charge is paid to Cheltenham Borough homes who have assured me they would not attempt this, even with huge arrears and that a D of V will be very costly and take around 3 months!

Has anyone else recently sold a ‘new build’ (2015 build) freehold house, with similar issues? My conveyancer is being next to useless and wasn’t even aware of indemnity policies to protect etc.
please help as we are desperate to get this moving!
