Private parking charge at Lidl

Hello,

I received a private parking charge from Parking Eye for overstaying in a car park at Lidl.    Having corresponded with Lidl I explained my reasons for overstaying.    They advised they couldn’t help with the appeal process, however I did get an acknowledgement in the letter which said that my reasons for overstaying were ‘understandable’.    Is this acknowledgement from Lidl as the landowner likely to be useful evidence to provide in the appeals process?    Unfortunately  I no longer have my store receipt

    It may assist , but ideally you want Lidl to cancel the PCN , as you were a valid customer !!  Plan A , nothing beats plan A !!

    Read the newbies FAQ sticky thread near the top of the forum , did the PE PCN comply with POFA ?? Or not. ?

    Yes or no

    Does the signage onsite comply with the BPA CoP ? What about clause 13 , grace periods ??

    If you are appealing to PE using the blue text template , on what legal grounds do you expect to be successful ?? ( So not mitigation )

    Unfortunately  I no longer have my store receipt
    Did you pay by cash?  If not, you'll have a bank/cc statement with the transaction showing. Normally (although they never advertise it), if you've spent > £30 in store, with proof, ParkingEye will cancel on appeal.

    If your reasons for being overstaying involve a person in the car meeting the definition of disability then there is no overstay.  Such persons are allowed more time and those details and evidence must be sent to ParkingEye. 

    Lidl can certainly cancel. They lied. 

    Also you haven’t done the basic first check if the PCN and told us if it’s POFA compliant or not.  

    There is a linked example of a non POFA ParkingEye ‘golden ticket in the 3rd post of the Newbies thread do please don’t ask us to look at your PCN, you can do the comparison and tell us.

    EDITED BECAUSE THE OP HAS JUST ADDED THAT HE IS IN SCOTLAND

    If you ignore ParkingEye you will be sued.  

    And ParkingEye do that all the time and would probably win because Judges tend to side with them and it’s an overstay, just like the Supreme Court case ParkingEye famously won to defeat the man in the street, and become the massive ANPR threat they pose to people today.

    The above won't happen in Scotland for a pre-2022 parking charge.

    Lidl can cancel this with one email.

    ParkingEye can cancel it as well if they get told about the disability and if you can show your bank statement. 

    You still haven’t said if this is a Golden ticket or not and I told you where the photo is to compare your PCN to.

    If you ignore everything you are likely to be taken to court.
    Continue ignoring and you will have a Default County Court Judgment against you which will make it difficult getting credit for six years. Think mortgage, phone credit, credit card, etc.

    Not forgetting of course that bailiffs may be sent to recover the debt - which has now grown to cover their charges.

    It's also best that you don't park your car outside anywhere near your home or work as you may well find it clamped by bailiffs.

    But if you are planning to move abroad for at least six years then none of that will trouble you.

    Are you sure court appointed bailiffs, or whatever they are called in Scotland, cannot use clamping?
