Unused Residence Nil Rate Band ... With No Residence

I was looking over IHT436 with the intention of transferring over my father's RNRB to help with my mother's IHT liability.

My father died in 1997 in Scotland leaving pretty much everything to his wife, my mother. However, he'd gifted his share of the house they lived in to my mother back in the 80s. Checking through his Confirmation, it states his address, my mother as his wife, and her address. There can be no legal doubt that they lived together at the time of his death.

Later on she moved to England, where she died, still a widow. She left her house to me and my sister.

My question is, as he didn't own a residence, is there a RNRB to use?

    Yes you can claim the transferable RNRB. it does not matter when the first spouse dies or whether they owed a house at the time of death or not.
