SOMEONE PLEAAASSSEEE HELP ME!
In 2007 I bought a house in Manchester with my ex, soon after the “credit crunch” hit and we literally lost half the value of the house. In 2011 we separated and I moved back to London (I have not been to the house since!). We couldn’t sell the house because of the massive negative equity, it has only just out of negative equity (we may have made £10!). Yesterday I checked my credit report for the first time in a long time and have found a CCJ from July 2020, apparently it’s because he didn’t pay the ground maintenance charge for that year!
I am so annoyed! Is there anything I can do about this, he lives in the house, we don’t communicate (I only have an email address for him!). I understand I’m on the mortgage and signed the ground lease it’s 1/2 my responsibility but how on earth can I get a CCJ if I knew nothing about it?
How do I get out of this house and anything to do with it, I don’t want money, I don’t want anything.....I just want out...it’s been 10 years I have my own family and husband....how can someone I don’t even know anymore (my ex) have such a negative impact on my finances without me having any idea?

With the house having no equity, selling fees and a solicitor....it’s going to cost me a fortune! I was hoping there was some sort of way around it where I can just sign it over to him 😭

I doubt you will be able to get it removed. As you say you are liable jointly.When you left you should have arranged for copies of correspondence to be sent to you also as you are still liable.
Give the management company or landlord (whoever collects the funds) a call and make sure stuff starts coming to you.1 -
You need to sort this out sooner rather than later. If he stops paying the mortgage or the house should get repossed at some point you will be laible for a lot more debt and your credit will be trashed.
You cant just be removed from the mortgage, your ex would have to take a out a mortgage on his own.1 -
I’ve contacted the ground maintenance company. Their argument is it goes to the property, which is where it should go 🤷🏻♀️ Looks like I’ll have to get a solicitor. Thank you0

Bit thats my argument, I don’t live there I haven’t for 10 years how do I know if I’m not informed, the amount varies year to year so it’s not like it’s a set amount. My ex has always paid this since he lives there...clearly he didn’t fancy it last year and didn’t bother to let me know. It’s so frustrating. Surely I can get the CCJ removed if I explain this to the court? The outstanding amount has actually be paid now (or so he says!)HampshireH said:

It's unlikely but your best asking on the debt board they will advise you how to go about it if indeed they feel you have a valid caseJodtay said:

Might be worth asking on the debt forum if it can be set aside. Obviously, they can then re-apply but if the debt is paid before gets back to court.......
Meantime, speak to both the management company and mortgage provider to see what you need to do to ensure duplicates are sent to you.
And tell the ex that he now has to re-mortgage or sell. I appreciate neither you nor he doesn't want to crystallise the loss but you now appreciate that moving on is hard to do in this situation.If you've have not made a mistake, you've made nothing1 -
