GSX Parking Fine Shoreham Port Help

Hi

I got a ticket for parking in a space for 17minutes at 5:50am,having no idea that you now had to pay there now. I tried to appeal the fine as a keeper but it was rejected today. I have been searching through this great forum for ideas to try to make up my mind as to whether to pay it or now and I'm still undecided.... I am so angry at these crooks and really don't want this hassle.

I couldn't see any successful outsides when GSX have been taken on and I read somewhere that GSX took know one to court in 2019 but was wondering if that was the same for 2020 and 2021 so far?

    I seem to recall one GXS case but otherwise just demands from debt crawlers and the BW Legal trying to make out they can ‘help’ and that not paying the extortionate £160 must be an ‘oversight’. 

    Don’t pay. Sit tight.

    You need to avoid Shoreham Port and Shoreham Airport, both ruined by predatory parking firms.

    Do you perhaps mean GXS Services Limited rather than GSX?

    Get those letters in the wrong order and your searching will be hampered.

    Oops, yes that was a typo and it should of been GXS.

    Do you know how I could find out if they had taken anyone to court last year?

    Send an FOI to the Ministry of Justice. You’ll have your answer within 30 days.

     I am in West Sussex and currently advising a friend with a PCN from Shoreham Port and he is 2 years down the line, no claim yet but is getting BW Legal letters pretending they can ‘help’ him.

    Thats really handy to know as I'm also West Sussex based!

    How would I go about following the claim updates you're helping out with?is there a post on here that I can follow?

    I'm just curious to see if it ever goes to court/the outcome.

    I enjoy it to an extent but these days I am of the view that County Court is not suitable for parking cases. 

    The appeal judgment by HHJ Simpkiss about Norma’s case in Lewes:

      ...was so badly wrong in places and full of holes, and he was (reportedly) so easily led by the PPC’s barrister away from looking at the evidence, and he appeared to have no clue about the Consumer Rights Act and the courts duty under that Act, that I tend to think courts are just not consistently up to this niche task, sadly.

    A decision like that is so bad that I am thinking a tribunal appeal system may be better. At least they’d look properly at the evidence and CRA 2015 and people would be protected from costs and not beaten by the money thrown at a barrister.

    Apparently I can't post as I am a newbie but I have a problem with this same company

    GXS SERVICES LTD Increasing PCN Amount Without Any Warning

    So I parked my car in one of this company's Cark Parks and got a ticket, but I wanted to extend my parking, but couldn’t because the company that calls itself “THE UK'S PREMIER PARKING OPERATOR“ machines only accept cash.  So I bought another ticket but unfortunately, I put my incorrect registration on the 2nd ticket so I put both tickets clearly on my dashboard   1st ticket from 12:37 to 14:37 then 2nd ticket from 14:19 to 15:19.  So anyway, when I got back to my car the parking attendant was there and didn’t say anything and we went on our way.   But 2 and half weeks later I got an email from my car leasing company saying I had been issued with a ticket and attached to the email was a copy of the ticket saying “Time of contravention 15:30” with pictures of when my car entered the car park and leaving the car park.

    So I appealed the ticket Stating that both tickets were on my dashboard, and asking why the parking attendant didn’t say anything when I went back to my car and that if I had been able to extend my original ticket this wouldn’t have been an issue.   But this was declined so I appealed to The Independent Appeals Service, but that was also declined and on the response, it said I had 14 days to pay, but when I went to pay the fine within the 14 days it had gone up by £70 to £170, so I sent them an email asking why the increase and asking where this is increase is documented, but I haven’t heard anything but today I have gone on their site and its now gone up to £240

    Any advice on this would be most welcome

    First you need to read the Newbies/FAQ thread and see where you went wrong in handling what is regarded as a "golden ticket" if you are the Hirer or Lessee of the vehicle and haven't divulged the identity of the driver. If you have not blabbed the drivers identity, inadvertently or otherwise, then you have a very safe defence, if/when this escalates to a court claim.

    Depending on whether GSX decide to escalate it that far and depending on which bulk litigator they choose to act for them, you need to have a thorough read of the second post in the Newbies/FAQ thread and come back if/when you receive a Letter of Claim (LoC).
