This is in place to prevent overstays in the car park and to allow more customers the opportunity to visit the premises. According to our records your vehicle was parked in excess of this free time, we have no option but to uphold this appeal

Did they really put this?  To my mind it means you won, surely they meant "reject the appeal"?

POFA is not a mandatory law , so they do not have to comply with POFA , nobody does !! It should have been made a mandatory requirement by MP s , but wasn't so is discretionary unless changed in the future

But , if they fail to comply with POFA then the keeper has no legal liability , meaning that they should pursue the matter with the individual driver !! Not the keeper

The fact that they may not know who was driving is their problem , because they have chosen the non POFA route !!

In practice they will assume that the keeper and driver are the same person , until proven otherwise , If true

Hence a non driving keeper has a good case unless the claimant has complied with POFA !!

POFA works both ways , helping the parking company if complied with , helping the defendant or appellant if not complied with , also helping a non driving keeper too if not complied with

Yep they upheld the appeal but that's because the person replying doesn't know what the words mean.

    Parking Charge Number (PCN): xxxx
    Vehicle Registration: xxxx
    Issued On: 14/07/2021
Issued By: Euro Parking Services Limited

    Appeal Outcome: Accepted

The Adjudicators comments are as follows:

The IAS adjudicator made their decision on 10/09/21.

Very good, just shows that Euro PS cases are worth throwing at the kangaroo court, if that PPC can’t be bothered to engage.  Suspect they are just looking to pick off ‘low hanging fruit’ victims like they did when they were clampers.

Firms like this will hopefully be kicked out in the long term, if the new Government framework polices and scrutinises things properly and doesn’t leave important complaint/conduct decisions up to the PPCs’ mates at the Trade Body.
