Whos insurance to go through theirs or mine ? - Non fault claim

My vehicle was parked in staff car park locked up at work, an outside contractor comes on site as he regulary does except this time he leaves his handbrake off.

His vehicle rolls a fair way down a slope and hits my vehicle head on the front end and shunts the rear of it into the metal fencing/post surrounding the car park so damage to the front, rear and rear side.

He accepts full liability and phones his insurance Aviva they send an email confirming he accepts liability and they want to deal with the repairs/claim etc.

I notify My insurance Brentacre/Winnsolicitors of the incident they also get confirmation he accepts liability and also want to deal with the claim/repairs.

Who do i choose to go with ?

All i want is my vehicle repairing properly and back to what is was before the incident.

When this happened to me I claimed off their insurance and let mine know for information only, Has yours presumed you are making a claim through them?

I would choose theirs because claiming off yours will affect your ncd until fully settled and you might need to renew before then (unless you have protected Ncd of course).
they are usually quite good in this situation as they prefer to keep control of the costs e.g. avoid expensive credit hire and court action, so its in their interests To satisfy you.
involving another party (your insurer) might slow things down also

I've gone through a non fault claim recently. I told my insurer that I was claiming through the other parties insurers multiple times and some how it's as if it's gone through my own. My insurer has said that their my insurer so why wouldn't they sort it. They say they are claiming back through the third party insurer. Two months later and I still haven't got anywhere with it. Looking at quotes my insurance premium has gone up £250+ and on the insurance systems it goes down as an 'at fault' claim until it is settled. I even have to put the claim amount on the insurance quote even though I'm at fault and the other party has accepted all liability.

Of course the downside is that if the third party  don't repair the  car properly or in a timely manner the OP cannot go to the ombudsman as they have no contract with the other chaps insurers

Because at the end of the day they will only expend limited resources and then draw a line. Your priority is not necessarily their priority.

The claim is simply more straight forward because its done in one and they'll provide an appropriate replacement vehicle etc rather than just a garage courtesy car if you need something bigger. Claim from your insurance and you have to pay the excess and then reclaim it, if you need a larger car they will pass sell your details to credit hire and there's a potential for a long battle as why you had to resort to credit hire at twice the price of a normal hire car etc.

The only time I'd consider going direct to my own insurers was if I thought there was a chance of the car being a write off as this is the one case where Ombudsman assistance may be appreciated which you dont get with a third party claim

Has to be a sense of realism though... repairs taking too long isnt something the Ombudsman is going to step in and resolve for you given their months of backlog ... they may agree a £50 compensation for the delay but thats it. On the flip side a TP insurer will be providing a hire car of an appropriate type rather than leaving you stuck in a 3 door group A courtesy car if the garage happened to have had one.
