Unpaid rent & tenant request for Section 21 notice

    Tenant is playing you for a fool. There is no problem with the bank, they need you to evict them.

    They can't just up and leave because they can't make themselves homeless so it's the long route for you.

    This can take between 6 and 12 months but because of the pandemic I would suspect it might take even longer.

    Just get the process started.

    This could well be a professional, they know the system and they know how long they can stay rent free until they get evicted and start again with another unsuspecting LL.

    Also please refer to my previous email regarding a section 21 or even a section 8 notice with a formal demand for the outstanding balance."

    May be a silly question, but can I not just issue him 1 month notice from my side, in accordance with the AST?

    What's in the AST is irrelevant. The Covid Act requires 4 months' notice at present.

    I don’t know exactly what’s in your AST but it cannot over ride statutory notice. Even without the Coronavirus Act 2020 you couldn’t just give the tenant one months notice. I strongly suggest that if you’re going to continue letting property you learn the basics.
