Ideally you download the N180 Pdf , fill it in and email to ccbcaq email plus email to claimant or their lawyers instead if using them
But the paper form can be filled in , scanned to pdf and emailed to both , so either is good , but posting is not recommended , it's a last resort only
Check for email auto receipts after completion , plus keep checking your MCOL claim history until you can see it's been logged
So check , no assumptions , safety first2 -
Hello all. To update on my case, I am waiting to hear back from the Court and to get a Court date.
However in the meantime, Parking Control Management have hit me with 2 further court claims for other PCNs in the same development.
The issue date from the County Court Business Centre is 6th October, however I only received them today! Because they sent them to my old address and I have recently moved house (at the end of September).
I have just filed the Acknowledgement of Service to both claims. Am I too late or have I managed to do it just in a nick of time? If its too late, any recommendations on what I need to do? (E.g. should I call Northampton Court and explain the situation?)1 -

You now need to ensure that both the Claimant and the Court have an accurate address for you.
Write to both of them - email is good. Make sure they correct it for all claims.With a Claim Issue Date of 6th October, and having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Monday 8th November 2021 to file your Defence.
That's two weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.To create a Defence, and then file a Defence by email, look at the second post in the NEWBIES thread.Don't miss the deadline for filing a Defence.

I filed one at 259pm and the other at 301pm according to the MCOL portal. (However the timestamps seem to be incorrect and I think it was actually 359pm and 401pm). Hopefully I'm lucky and they're both counted to have been on time.

Include the stuff you find when you search the forum for 'cause of action estoppel Henderson' because they can't file moneyclaims bit by bit. It's an abuse of the court process. These should ne easy to stop, if the court listens in the end if you keep stating it in every email.
Re the first claim...so, I assume the local court and the C still both have your old address on file...not good!
You need to email the court and Claimant's solicitor re the ongoing allocated claim and tell them your address for service has changed and to erase the old address and rectify their databases to (new address) immediately and if any documents have been sent to the old address since allocation, please re-post them.
Are you past DQ stage at least? Case allocated locally?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I have read up on Henderson. I can definitely use this for one of the additional claims because the 'parking contravention' is the exact same thing ie allegedly parking in the temporary parking bays without a valid permit. I will use an almost identical defence to the one that you helped me with on the 1st claim, but I will just add in this additional point about Henderson as well.
However the 3rd claim is for a slightly different contravention - parking in my own allocated parking bay (the bay is owned by a family member who gave me permission to use it), allegedly without displaying the right permit. (I did normally display the right permit, but over a number of years every now and again it would slip down the dashboard and out of view). Given that this is a different 'contravention' - can I still use the Henderson defence in this case?
For the 1st claim, I am past the DQ stage and I received a letter on the 23rd September saying that the claim has been transferred to the local court that I requested and the "file will be referred to a procedural judge who will allocate the claim to track and give case management directions. Details of the judges directions will be sent to you in a notice of allocation".
I haven't heard anything since. I am writing to all parties to inform them of my new address but thankfully I still go and pick up post regularly from my old address so hopefully I will have all bases covered and won't miss any communications.

I called my local court this afternoon to inform of my change of address and also to check on status. Apparently a hearing date has been set. For May 2022!
I am writing to them to request details of the hearing date in writing, because I haven't received any notification in the post (not even to my old address)2 -
Sorry for all the posts but 1 more question. I've noticed that one of the PCNs on one on the recent claims relates to a date which I have no record of receiving a PCN on.
There is no record of any parking tickets or photos relating to this particular date in the Subject Access Request response that I received back from the parking company.
Do you think they have made a mistake with one of the dates? And if so, any suggestions on how I should best respond to this in my defence?1
