Hotel refund section 75

Hi looking for advice ..booked hotel 2019 in Kefelonia for 2020. Flight cancelled due to lockdown, moved to 2021 flight cancelled again and against FCDO advice to travel. Hotel rebooking for 2022 dates not available with work and they’ve advised deposit no longer available. Booking is now cancelled.  T&C non refundable deposit. Tried chargeback no joy as outside of 120 days. Will section 75 support a refund?

    From the information provided I would say No to S75.
  • S.75 gives you the same rights against your card provider as it does against the hotel so unless there is a reason you think you are entitled to a refund of your non-refundable deposit then you won't have any sucess with a S.75.
  • Thank you my only thought was is consideration given for services not received due to flight cancellation and travel against FCDO advice.

    Neither however are a breach of contact by the hotel.

    Travel insurance is another avenue to try.

    The hotel is open. Your choice whether to use what you've booked or not.

    what does the above have to do with the hotel?

    unless you booked a package.......?

    If you book a hotel independently it's not their problem how/if you can get there, they are only responsible for providing the service (which presumably they did)
    S75 would only cover you for the hotels legal liability which is to provide the hotel service (which presumably they did).

    Did you have travel insurance to cover you?
  • Thank you..Yes I’ve got travel insurance however need to exhaust all avenues before I go down this route.

    I think you probably have unless you can try again with your employer to get the holiday dates you need for 2022.
  • There’s 8 of us and 4 are struggling to get the dates. I’ve  asked the hotel for a voucher to use again but no reply yet. I’ll revert to insurance company if I don’t get a response from hotel within next few days. Thank you

    Just to echo the above, the insurance company will probably be your best hope - the hotel have stuck to their terms and your travel problems aren't their concern unfortunately.
