Parking Charge Notice - Aldi, Corporation Street, Preson

Hi All, hoping someone can help. I have received a letter from CST Law, regarding an Unpaid Debt - Reminder Notice for £160 (up from the original £100 demanded by Care Parking). This follows 5 letters from Debt Recovery Plus (DRP) demanding the same, and 2 letters from Care Parking, the first of which I replied to providing evidence of my shopping trip to Aldi (and a quick browse round the other shop, Poundstretchers) last November during my lunch break. I have already disputed the PCN, and denied their claim that I left the car park having proven that I was there for approximately an hour and spent that time in the shops. They basically took pictures of the car parked (legally between the markings) and claimed their operative saw me leave - which I dispute.

I have already received support from someone on MSE who successfully challenged their PCN through POPLA for exactly the same "Abused Patron Parking" accusation levied at me; however, I have not responded to any of these subsequent letters as I already felt I had responded and provided what evidence was required to clear this up. I regarded these subsequent letters as no more that idle scam threats.

So should I contact CST Law now that a third company is harrassing me, and inform them that the PCN was issued in error, as already made clear to Care Parking?

The 5 letters from DRP all issued ultimatums which they then extended inviting me to settle, and the letter from CST Law does the same; The wording states "our client would like to resolve this matter amicably without court action, a a claim would result in an increase in the amount sought from you in terms of any Statutory Costs and Court Fees"... and "our client to provide you with this opportunity to make full payment of the sum... thereby avoiding court action being taken and any increase in the amount claimed". I have heard that spurious claims are issued all the time, and  that they pressure people into just paying regardless of their case, and I am not willing to buckle under such pressure.

    Yes, reply and repeat the same evidence and tell them to tell their clients to cease and desist because this is now harassment, knowing as they do that there is no cause of action to justify the pursuit of this charge. 

    And stick around on this forum for a few weeks to ensure you take part in the final Government Consultation that I keep posting about. 

    You will get no other chance to tell the Government about what you think about being hounded for £100 parking charge with no evidence, and to which they have added an illegal and unrecoverable £60 in order to ramp up the pressure and share the spoils with third parties who have no place in a consumer-led Society. If the PPC thought they had a case they could have used small claims, which are the only fees they can add. 

    Come back and take part this Summer when the Consultation will open...and we will be talking about it.  People like you are needed to balance the greedy rhetoric of the parking firms and Trade Bodies, who will take a second bite at the cherry to try to persuade the MHCLG that a massively disproportionate 3 figure sum is needed to deter rogue drivers.

    it is clear the rogues are among the parking firms and parasite ‘debt recovery’ firms.

    This seems to be a good scam by care parking taking photos of cars then claiming abused patron parking.
      We have exactly the same last November with my wife who at the time was at work on site, now have after three request  and threatening with ICO we have the permit off care parking allowing car to park? now awaiting court claim.
       Any how this is the email address of the management agent that may be able to help it is the lady we have been in contact with. I know of 1 other  case quite recently exactly the same.

    Excel v Wilkinson

    At the Bradford County Court, District Judge Claire Jackson (now HHJ Jackson, a Specialist Civil Circuit Judge) decided to hear a 'test case' a few months ago, where £60 had been added to a parking charge despite Judges up and down the country repeatedly disallowing that sum and warning parking firms not to waste court time with such spurious claims.   That case was Excel v Wilkinson: G4QZ465V, heard in July 2020 and leave to appeal was refused and that route was not pursued.  The Judge concluded that such claims are proceedings with 'an improper collateral purpose'.   This Judge - and others who have since copied her words and struck dozens of cases out in late 2020 and into 2021 - went into significant detail and concluded that parking operators (such as this Claimant) are seeking to circumvent CPR 27.14 as well as breaching the Consumer Rights Act 2015.   DJ Hickinbottom has recently struck more cases out in that court area, stating: ''I find that striking out this claim is the only appropriate manner in which the disapproval of the court can be shown''.
