Title Deeds

Having decided to sell our house, I understand that the title deeds are electronically held with the land registry.  My question is why has my bank (RBS) been charging me £25 per year for holding my title deeds in safe custody.  I’ve never had a mortgage with the RBS.  But as we banked with them we thought the safest place to keep the deeds was in our local bank.   My local branch has closed and the nearest one is nearly 9 miles away.  Do our paper title deeds still exist, and where are they? Have we been paying since 2009 for something that doesn’t exist.

    Presumably they've been charging you for storing deeds in safe custody because you gave them some deeds to store in safe custody!

    The legal title may be registered but there are often other "deeds" to do with the house (consents, warranties, or perhaps older deeds that have some use), but we don't know what you gave them.

    Ask for them back. 

    If they find they don't have them......

    We passed on the paper deeds of Dad's house to the new owners. The deeds don't have any legal meaning once the property is registered at the LR but they can be of interest, showing the history of the house. 
    It was your choice to pay the bank - you could have kept them at home.

    Can I ask for a refund ?

    Yes, that would seem reasonable. And for costs in getting copies of anything you actually needed out of what they've lost.

    If the do still have your Deeds, you should put them somewhere safe. The record of the title held by the Land Registry is NOT a copy of the Deeds. The Land Registry also make mistakes when recording titles, so keep your deeds save when/if you get them back.
