    Legally your liability now stops at the amount the CSA say you must pay. If you paid your ex just that and no more/no less how would that affect things?

    If that means you paying more to your ex then its tough on you and yes thats the system. BUT if it means she actually gets less then she might change her tune sharpish once she has to find the cash for the other half of the school fees, holidays etc.

    In the short term yes it might affect your daughter but you may have to bite the bullet for longer term gain.

    hi if you have recepits and a list of things and amouts you pay for dont the csa deduct this from maintance you have to pay? because i was asked how much and what my ex pays for because it would effect the amount. which i have to say he hasnt paid or contacted my 7yr old daughter since she was 4.
  • I had a list of things that I paid for in lieu of child maintenance when my case was first being processed by the CSA. These items & cash payments were verified in writing by my ex. These items totalled over £1200 over about 3/4 months.
    Even after extensive arguing with the CSA, they still disallowed around £900 of my claim & therefore, I started off with large arrears.
    If I knew then what I know now, I may well have taken it further although that would probably have added more stress at a difficult time both emotionally & financially.
    Donedoingdebt Lightbulb moment January 2000. Debt at highest approx £102,000. Debt now (October 2009 - absolutely fork all!!!):beer:

  • under new rules where shared care is shared equally there would be an allowance of 182 nights per year allowed as any more and you would be deemed the principle carer. in this case the liability would be reduced by 3/7th and an abatement of £7per week would be allowed. It should be noted that child benefit isnt automatically paid the the childs mother - Anyone can apply and it can even be split in some cases. For child support purposes the person who received child benefit is deemed the principle carer.

    They can only offset any payments already made for a period where they have not yet calculated an assessment but have a live case. Otherwise, the only legal obligation the NRP has is to pay what the CSA ask them to. if they choose to pay extra for things that is their choice.

    Under my care arrangement, I look after my daughter for 185 days this year, and yet I havent been awarded the PWC by the Child Benefit people.

    Under the Care order, we are supposed to be in a shared care (equal) care agreement.

    Doesnt the Government have an obligation to treat both parents equally under human rights legislation?

    child benefit will only be split if there are 2 children. they will not split it for 1 child.

    secondly, try telling the benefits agency that it isn't automatically paid to the mother.

    thirdly. try getting it off the mother.

    You need to tell the pwc that if she continues with the csa you will stop paying the school fees and any extras and she will have to manage solely on what she gets from the csa. This woman is being greedy beyond belief and you need to put a stop to it otherwise you will be walked all over (look at other people in similar positions on this site). Advise her that you will only continue these extras if she closes the case!:mad:
