Remote/Keys to Open Electrified Gate To The Garage Not Handed Over Upon Completion

    I wasn't given the fob to open the electric gates at my apartment block to access the carpark.

    The previous owner was not forthcoming with the missing fob when contacted by her solicitor. She used another solicitor in the same firm as mine, and the estate agents had no luck either.

    I had to send off for a new fob at a cost of £50, which was then reprogrammed. I got advice as to which fob I needed from the company who did the yearly maintainance check on the gates. Apparently the generic ones were not suitable.

    I would do this then send the previous owner the bill for the replacement 
    30th June 2021 completely debt free…. Downsized, reduced working hours and living the dream.

    The trouble is that they may well ignore you. Do you then sue?

    It’s covered by question 14 of the TA6 form. At least it is for English transactions. The seller confirmed that all keys for doors and windows would be provided, assuming they ticked the yes box. If they ticked no, I don’t think that the sale would have gone through. 

    The form is incorporated into the contract.
