Problem with law firm.

Hi forum,

In December 2018, I was waiting inline to move onto roundabout when I was hit from behind.

I was contacted by a "no win no fee" law firm, who I agreed to acting on my behalf.

I was off work for a week and suffered with shoulder & neck pain. I was sent to one of their doctors for an examination, and he could see evidence of my injury.

After quite a few months, they decided they did not have enough evidence and that the lady who went into me was prepared to go to court (so was I !) I should add, that I did have forward facing dashcam footage clearly showing time of impact, but not of actual contact.

Quite another few months later, and I get a nasty red letter from the law firm, stating that I had to pay £216 for the medical report which they sent me to have, with notice that they would take action against me if I didn't pay.

So, I paid.

I have since been having further issues with my neck & shoulder, and I have emailed and called them, asking them to forward the said medical report, which I now see as my property, or at least, free for me to use. Emails are unanswered, and when I call, I can't get past the receptionist who promises that "this time" someone will call me back from the relevant department.

My question is, Am I correct in thinking they should send me a copy now that I've paid for it, and if so, Is there anything I can realistically do to force them

    How long ago did you first request it? Yes, of course you're entitled to a copy, but if it's (for example) sitting in a building which nobody is currently working in then it's not necessarily going to to be a swift process to get access.

    Do a Data Subject Access Request for a copy of the records including the medical report which they are legally obliged then to provide within the statutory time limits

    Give up on the receptionist.  All law firms should have a documented complaints process.  Start a complaint.
    If it sticks, force it.
    If it breaks, well it wasn't working right anyway.
