Excel Parking Demand for Payment

Options
Hello

Unsure what to do. Today I received a letter Demand for Payment from Excel Parking. They are demanding £160, £100 parking charge and £60 debt collection cost.

I disputed the original PCN on the grounds of only being in the car park for 9 minutes, unable to pay at machine or via internet so left the car park. They turned down the appeal and continue to reference ParkingEye ltd Vs Braves on my challenge to the fee being extravagant.

I do not want to pay, but don't know what my best course of action is.

They do know I was driving

Any thoughts welcomed
David

Did you miss the NEWBIE sticky just below where you clicked on New Post button?  All answers and the process will be found there.  You probably need to start at the second post as you have appealed and lost, although you could try Plan A, a complaint to the landowner/retail establishment/pub/restaurant/hotel/ residential complex.

    Hi David,

You appealed but the system you were up against isn't a true appeals service, so you were right not to try IAS 9second stage) and had no hope of Excel accepting an appeal because the system is bent:

Come back to us when you get a Letter before Claim, or Claim form (easy to defend - you didn't enter into a contract).  Ignore debt begging letters along the way.  Same advice as here, no paying it!

Stick around and read more threads and please do the final Government consultation mentioned by me there.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

David, have you based your forum username on your real name? If so, you may want to get your forum username changed to something completely anonymous.

To help with that, have a read of this item from the Forum's FAQs:

    Can I change my username?

In most circumstances, we don't allow this.

The only reason we will change your username is if it puts your privacy at risk e.g. you've inadvertently registered using your name, email address or something which gives away your identity within your username.

If you fall into this category, email forumteam@moneysavingexpert.com your current username, the email address you registered with and three alternative usernames in order of preference.
