Aperture/Debt Movement IVA
I am hoping some one can help me or share any experiences of the above "company" or offer me any advice in dealing with them. Initially I dealt with Aperture now I have had correspondence from Debt Movement but upon contacting them they have directed me back to Aperture.
I have a settled IVA which is being managed by the above companies.
I made a successful PPI claim almost two years ago which has sat undistributed to my creditors in the IVAs account since then. I am aware that the money to be distributed is to the creditors not me but my Father is one of the outstanding creditors and he has received neither communication or payment from them since the PPI money went into their account.
Recently I received a cheque from Debt Movement for the PPI payment. I'm unclear why this has been sent to me rather than the creditors? When I contacted Debt Movement they said that they had no record of the reference I gave them (which was on the letter from them!) and directed me to Aperture who have no phone contact and beyond an automated email don't seem to reply to emails even in the given 10 working day time frame. I am trying to establish if this is a payment I am entitled to or if it is one that needs to be distributed to creditors. if it is one I am entitled to why my Father (a creditor) is yet to hear from the IVA company or have any of the money distributed. The amount I was offered before deductions is between a half and a third of what the PPI claim was.
Having seemingly established that Aperture/Debt Movement are either one and the same or connected I notice that along with the payment offered they have deducted not only the IVA management costs of a grand (for doing nothing for two years?) but also added one on for a couple more grand for Claims Management. As I never instructed Debt Management to act on my behalf and they seem to be essentially one and the same as Aperture this seems to me to be pretty outrageous. The letter informs me if I don't claim the money in the next 12 weeks (one week already gone) the money goes back into the agreement where it will presumably sit until their fees have wiped it out?
I am currently looking at complaining to the Ombudsman but with delays and the time frame given it looks unlikely I would get any resolution form them before that 12 weeks period expired.
So can anyone help? If you can it would be hugely appreciated.

I would bank the money as soon as possible.
These IVA companies have a reputation for absurd working practices, nothing happens very fast in these instances.
The fee`s they can charge are set out in your IVA proposal, you would have agreed to them when you started your arrangement.
Challenging fee`s after the fact wouldn't be very productive in my experience.
As a creditor, your father will be in line for a disbursement, but as I said, nothing happens quickly in this business.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards.
