O’Neill - stores closed but won’t allow gift cards to be spent online

Hi. I don’t know where I stand with this. Just before lockdown I bought some ski gear for £130 at an O’Neill store. Unfortunately I got pneumonia a week later and couldn’t ski so I returned the items. Apparently these were sale items (I wasn’t aware of that - it wasn’t obvious) so I could only have a gift card instead of a refund. I’ve just discovered that ONeill no longer have any UK stores but I can buy online from them. However they say I can’t use the gift card online - only in stores. Which don’t exist.
I bought the original items on a credit card but I’m not sure if the gift card is covered by that original transaction.
The gift card has not yet expired
anyone know for sure what The legal situation is?

As you bought in store you have no right to a refund at all. The gift card was a gesture of good will above what they needed to do...
But you accepted the exchange of returned items for a gift card.
It was a risk accepting a gift card, given stores had been closing and administration were called in to the UK stores at the end of 2019.
All you can do is contact the company in writing and appeal to their better nature.
Your credit card cannot help as it was not a distance sale, and you were issued with a gift card that was valid at the time.
Is the gift card valid in the stores abroad?? As you missed your ski holiday, then perhaps a trip to Germany instead???Should've = Should HAVE (not 'of')
Would've = Would HAVE (not 'of')
No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)0 -
Sounds like it was multiple items and therefore S75 of the credit card is out of option even if you had any rights because it only covers items individually worth over £100starkraving said:

The online store is operated by a Dutch company so is likely to be a separate legal entity to the company that owned the UK stores and therefore with no obligation to honour your credit note.0

Yup, I believe the UK stores folded and the online part is a different company - so they owe you nothing0
