    In the many years I have advised people on such matters, I have always based that advice on the rules in force at the time, but explained that rules may change in the future. A classic case was advising on the creation of accumulation and maintenance trusts, and discretionary trusts from which the settlor could benefit, in January 1986. The former would have been better left until after 18 March 1986, but the latter would not have happened at all after that date.

    If a change in legislation is strongly suspected, that is almost always an adverse change, so the advice is to get on with things. I have never been confident enough of a possible future beneficial change in legislation to recommend something that might benefit from it. Why would you? You wait until the legislation does change, unless there was no downside. Your example was a case where there was no downside.

    I am not sure on that part as HMRC will not accept amended returns etc. in relation to SEISS, only documentation submitted before the deadlines can be taken into account.

    I also totally agree with that part, regardless of the outcome of the process with HMRC there is always a way to resolve the connected issues longer term.


    Thanks to everyone for their kind very informative replies.

    Along with normal work I am my dad's unpaid carer so my day starts at 7:30 and finishes at 10:30 7 days a week so for about a day I panicked and got really stressed, but sat down with my wife who was also upset and thought, no point in thinking how or how not the HRMC should treat us, I just have to get on with it. Plan for the worst and I will just have to somehow work harder to pay them back
