Surveyor said my flat was worth the money but I can't sell or remortage 3 years later.

The surveyor very carefully said “no problem with resale”. NOT “no problem with resale to someone who needs a mortgage”. He also made a further catch all caveat relating to “normal market conditions”. It looks like you read far too much into what he said or did not understand it. Because you were able to buy without a mortgage obviously means you were not aware of the limitations in securing lending with this type of property.0

I feel sorry for the op. There should have been some sort of caveat in the report about it being non mortgageable. In her position, I would be showing the report to a lawyer. A bunch of strangers on a forum cannot help.No reliance should be placed on the above! Absolutely none, do you hear?1
