    Reading through the thread it seems you stand :
    • between the landlord and the other party unnecessarily (and could waste money unnecessarily)
    • he appears to be:
    • either possibly a licencee/tenant of the previous owner and now the present owner (charity/landlord (not you)
    • or possibly was a prospective seeker of adverse possession against the owner (not you).
    If you want to buy next year the owner/landlord needs to clarify or "regularise" the situation for the prospective buyer. Otherwise if it goes on the open market next year the Home Information Pack will have some interesting features.

    As others have said it is not your problem - the potential dispute belongs to the owner.

  • hi, thanks there's no dispute who owns it no, its there in black and white but the thing is the stuff that is in it techinally isnt even his, its the dead guys who left it all to charity, house and garage contents plus proceeds from sale of house. what happened there was he put a bill in for maintaining the house while it was going through probate and got nothing, mainly because he did nothing apart from put a fire on to stop the damp!! what a mess, all i want to do is park my car and store my patio furninture instead of lugging it to my dads.

    You have rented a house which includes a garage. At present you do not have use of the garage. You need to tell the landlord/agent - it will be for them to sort this out.

    Don't get involved with the neighbour. Contractually - in law - he "owes you nothing". He is, however, trespassing on the landlord's property so it's the LL that has all the power here.

    Get onto the landlord (or the agent).
  • i took your advice and contacted the landlord this afternoon and he's putting it in the hands of the solicitor. the garages are in a large piece of land at the back of the terraces, the houses on four streets back onto them like a kind of square with the garages in the middle and three dirt tracks running in. its where we put our bins etc for the bin men. the land the garage is on is owned by a guy who no longer lives in the area but he's sold the plots to many people who used to rent.

    i'm going to leave this in the solictor/landlords hands now but thanks for the advice, i don't want this to get ugly so its best to go about it legally

    i helped my mates brother move a garage arrount the garden once, never again they weigh a tonne, would have been a lot easier to just take it appart.

    if it were me i would have talked to the landlord so they oked me acting on their behalf the ripped the locks off and dumped the stuff on the street/ neghbors garden depending on how moody i was.

    I think that it is all getting too complicated and expensive.

    If a previous owner of the house you rent bought a plot (I assume he /she did not buy all the land) all you have to do is wait.

    The solicitor will be able to confirm to the present owner (your landlord) the nature of the status of the land, ie whether or not it is owned or held in some other way.

    If it is owned by your landlord possession will probably be obtained and your tenancy can go ahead.

    If it was originally offered to you with vacant possession no doubt the landlord may clear it for you.
