Insurance policy after not at fault write off

My wife was in an accident, she was not at faul, she was rear ended right in front of police who were attending an accident on the other side of the road! Police said my car is a write off as there's structural damage, insurance seem to agree, but want to check car first and then send a valuation for compensation.

The other driver has obviously accepted fault (going way too fast round a blind bend and hit my wife who was stationary). Their insurance are delivering us a hire car tomorrow to cover our lost car.

I paid my premium up front (wife is named driver), there's 10 months remaining, we are not claiming a penny from our insurance, everything is going through hers (direct line).... What happens to my policy? Does it get cancelled? If so, can I claim a partial refund? If not, can I transfer it to a new car?

    If you say you are claiming off the third party insurers then you have two options... cancel the policy for a partial refund (minus fees) or transfer the remainder to your new vehicle with an premium refund/addition depending on the difference in vehicle.

    Remember if you are claiming from the TPI and don't like their valuation you have no rights to access the Financial Ombudsman

    Not sure about valuation, guessing that will come through on Monday morning (crash happened commuting home Friday evening).

    Car was a 2008 (58) BMW 325d se highline 2dr coupe (e92).... In good condition with 127k miles. It was the most reliable car I've owned, hence I've kept it for years and serviced it myself as was planning to drive it into the ground. Annoying because I loved that car, and there are less and less about every year so it's hard to find like for like. Quick Google puts the private value at around 3k (my reg is AD58VJN) but I can't find one that cheap anywhere.... Closest match is this one (http://www.autotrader.co.uk/car-details/202106103690169) for £4650, which doesn't have as many optional extras as mine and is older, but fewer miles.... Let's just wait and see what they offer. Because I can't find like for like; it's hard to find the se model, there's a few m sports available, but they're generally slightly more expensive.

  • Initally they tried to offer me £3300 which was instantly rejected.... In the end I managed to get them up to £4k which I'm happy enough with, and can't be bothered to go down the legal route just to try and get a few extra quid (i.e. max £500 extra); it's simply not worth my time.
