Seller took house off market after offer accepted

Hi looking for some advice please with the current situation I’m in. Small bidding war for a property and got offer accepted. Seller wanted to move fast as did we. After a few weeks of no communication to our solicitor the seller contacted to say they couldn’t find something to buy. We were very understanding and flexible and we’re willing to give seller 5+ months to find a property they liked. After 2 weeks agency contacted to let us know the seller is pulling out of the agreement and will be revisiting selling in the near future.
Now just want to know where we stand as the listing hasn’t been removed from online and is still showing as under offer. If the seller decides to sell in the next few months we have been told we will get first refusal if we are still searching. But I find this hard to believe after being messed around so much.

Thank you for any advice in advance.

You stand in the same place as anyone else.

If the house comes back on the market, you can put in an offer. The vendor will select the offer that suits them best from all they receive.
  • You don't have any say.

A seller who wishes you to hang around while they make things perfect for them isnt worth the aggro.

Keep searching and they may come back to you in the meantime anyway.

I believe buyers will carry more weight now that this ridiculous scenario of king of my castle is coming to an end.

Thanks for your reply. So unfortunately just another fob off from the agency saying we’d have first refusal.

The EA is just passing on the vendors decision that they have decided to stall moving. They may or may not start looking again and if they do the EA said he'd let you know. What else do you think the EA can do?

The listing still being online doesn't mean anything either.  Maybe their admin person is on holiday or off sick or just hasn't got round to submitting the change to Rightmove (or wherever).  Or some EAs seem to keep properties listed even when off the market as adverts - makes them look like they have lots on the books and lots of sales.  My friend's lovely house was listed with one EA for at least six months after they'd sold and moved, presumably because it looked great and generated calls so they could regretfully claim it had "just gone under offer this morning" and then suggest something else.
