Potholes

“My four-year-old car went for its MOT on the 29th March 2021.  The service department called me the same day to say my car had failed its MOT, because there were tears on the front tyres but also, the ABC pump/suspension struts were damaged and leaking oil on the nearside of my car.   The tyres had to be replaced that day as I had no other transport.   I would not have felt safe driving my car and it was dangerous, plus I had no other transport.  

The ABC pump/hydraulic suspension struts were replaced on the 14th April.  

ABC pumps/suspension struts normally go between 50,000 – 100,000 miles not on a car that has only done 16,204 miles in four years. Also, from my last service in March 2020 to March 2021 I had only driven 1,400 miles.    

Tyres should last around twenty thousand miles, not go after 16,204 miles.  My car is garaged and well looked after.  I am a careful driver  with a clean driving licence.  

My pot hole photos taken on the 4th April and dash cam footage that was taken on the 29th March 2021 of the pot holes were taken before I put the claim in on the 12th April.   They also showed that the pot holes had been marked with white spray and numbered so the Council were aware for some time of the issue as these white marks had been on the road for months and still, they made no effect to fix the problem.    I also have photos of what the road is like when wet and you cannot see the pot holes, so image what it is like driving along that road at night with no street lights. 

They have since repaired some of the pot holes in the last six weeks but not all .  In fact, I have dash came footage of me driving out into the middle of road back in 2018 to avoid pot holes, so this has been a problem along that road for a number of years.”  

Surely it is down the Council/Highways to keep our roads safe.    

Why should a tax payer have to keep reporting the problem and being out of pocket, when we pay enough each year in road, council and fuel tax?   

I am seriously thinking about stop paying my council tax and next year taking my car off the road so I don't pay road tax, because I am tipping money down the toilet.  Why should I claim off my car insurance and lose my no claims bonus.

Do you think I can claim in a small claims court.
