My Boss is Lying


I went on sick leave prior to the furlough starting for stress due to my boss making errors at work and covering it up and blaming me.

I have evidence printed and other documents proving that it was not me but it was my boss and other staff members that caused the errors.

As the management think the sun shines for my boss they believe her and not me.

After being on furlough for a while and I am unable to return to work as the doctor has signed me off with stress and this situation has killed my confidence.

Should I take the company to a tribunal with all the evidence I have, also the boss who was accusing me has now left the company which is nothing to do with this matter by the way.

The HR dept has said the matter is closed

If I went to a tribunal could I ask for her to attend so she can explain why she did this.

    I'm sorry that you have been badly treated by your employer. If you think that having your employer admit to you that they now understand that your boss was lying would improve your confidence, you can ask them to confirm that they understand this. You can make the point to them that that it is partially their distrust that hurt you and caused you to be off work with stress. 

    The tribunal could order that your boss attends, but they are either likely to not attend or to lie, so I don't think I would push for them to attend. I think you should focus on getting back to work and putting this behind you.

    There is clearly more to the problem than a lying manager, as that manager has left but the OP is still stressed out about returning to the workplace.

    Have you provided all this 'evidence' to HR? If not, do so now. If you have, given that your boss has left, it's no surprise they regard the matter as closed.

    You talk of 'taking the company to a tribunal' - but on what grounds? Highly unlikely the tribunal will ask your former boss to 'explain why she did this' - it's pretty obvious (called passing the buck).

    You've still got your job despite the errors you say you were accused of; your boss has left. Returning to work may be difficult, but perhaps that's the conversation you need to have with HR.
    Googling on your question might have been both quicker and easier, if you're only after simple facts rather than opinions!

  • Sounds like you need a new job I'm afraid.  Let go of getting justice.

    They will believe what they want to believe - I spent 5 months in work last year, my bosses wanted to believe someone else was doing the work, it got to a point where I went along with it, it came out in the end, still wasn't pleasant. In fact, it only got worse, nothing good came of it. Again 2nd job of the year, ageism bother for me popped up, I was before HR before I knew it, wishing I hadn't brought it up.

    I'm fortunate where I work if I wanted to complain about my Manager, there wouldn't be anyone to complain to as they own the business as it were. (this is just the way to go!)

    How long have you been employed there?  For most tribunal cases (with some exceptions), you need 2 years service.

    If the errors continued after you stopped working then it would be clear there was potentially more to this than just you.

    those in charge would see this, if they have all stopped then not so easy to make your case.

    The only way you can do that, unless they were to dismiss you, is to resign and claim constructive unfair dismissal. That is a very hard case to win and less than 3% of such claims that get as far as a tribunal are won. Obviously some more are settled before hand but even so.

    A tribunal has a very limited remit. It does not simply look at what the company has done and replace its decisions with the tribunal's. It has no meaningful powers to order the company to change course. Ultimately all it can do is award some financial  compensation to those that it judges to have been unfairly dismissed.
