Worried about Guarantor?

hi im 28yr old and i live in a one bedroom flat, my moms husband is my guarantor and they are going though devorce and im worried they will pull out and i will get evicted, ive lived at my flat for 2years and always payed rent on time and deal with my landlord directly, what can i do, will i get evicted, thanks in advance

    They can't pull out. They are legally guarantors until the tenancy ends no matter what they want to do.
    Have they actually told you that they want to pull out?

    As above, they can't pull out of being guarantors.

    But I guess they might put moral pressure on you to end the tenancy, in order to release them as guarantors.


    Do you think they might contact your landlord and 'kick-up a fuss'? As I say, they can't pull out of being guarantors, but the landlord might start thinking it would be better to have a different tenant who has more willing guarantors.

    But being a good tenant and always paying your rent on time will also influence the landlord in your favour.  (Plus the landlord would have to pay fees to find a new tenant, and might have a void period.)

    so its not my mums husband who is guarantor its his father, hes father is really good friends with the landlord my moms husbands father is also the guarantor on my mums house too

    Keep up this good record of full and on time rent payments and the issue of the guarantor is not relevant.  With rent always correctly paid, the LL has no reason to try to evict.
  • Think about it, what  would be the point of having a guarantor if they could pull out at any time? The whole point of it is that they are promisiing to pay if you can't, and they are tied into the contract as long as you are.

    So although they might want to pull out, unless your landlord agrees to it, and no longer needs the guarantee, they can't.
