Refund rights

I was due to go to Florida in 4 weeks time. This is obviously looking very unlikely

My holiday provider is not being great with comms around refunds. They have said that we would only get a refund if the flight is cancelled. As this is a connecting flight from Manchester to Frankfurt to Orlando its unlikely that it will be

My question is, if the US are not letting us in, are we still able to have a refund if we are not allowed in

The holiday was booked as a package

I can't see how we can't get a refund if we cannot get into the country. The holiday provider won't answer this and keep repeating the bit about the flight being cancelled

  • You should be entitled to a refund if it is actually a package you have booked. Getting one in practice may be a different story.

    If you provide a bit more key infromation such as who the "holiday provider" is and what you have booked then people may be able to give you more specific and practical advice.
  • I’m not going to name the provider as that doesn’t make a difference but it’s definitely a package holiday
    The query is simple if a flight isn’t cancelled but the country will not let us in surely under the package holiday rules we should get a refund

    holiday paid on 2019 for last year and then moved to this year.

    Well that is of course up to you but it does play a part in the responses.

    A reputable tour operator will typically follow the travel advisory issued by the FCDO, so BA Holidays, TUI and similar would probably be offering you options to change your holiday, a credit, or if they cancel then a refund.   Others, such as those who have cobbled together a package, such as Lastminute.com, On The Beach or LoveHolidays will not necessarily follow and accept the FCDO guidance and only refund you what costs they can recover themselves. That fits with the woolly answer you have been given re the MAN FRA MCO flights.

    Naming the holiday provider as above does help, although doesn't change the legal situation for you.

    If on a package, you have a legal right to a refund in these circumstances, as detailed in the Package Travel Regulations.

    If you've paid by Credit Card and the agent has packaged together separate flights and accommodation, you should have a right to get your money back under Section 75 due to the service being sold to you being put together by them.

    If that fails, Chargeback is an option, either for CC or Debit Card. This will only be in the event of a legal right to a refund, which you may have to leave it another 2 weeks to see, as anywhere between 14 and 28 days seems to be cut off for this.
