So don't guess when the letter was received and DON'T talk about 15 days (I guessed right that this was unlikely, due to years of experience here! You did not receive this on the Sunday nor on Bank Holiday Monday, so you saying '15 days' was wrong and too generous to them).
Put the above calculation about when it was DEEMED served = too late for keeper liability.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Yes, good catch. I'm updating my appeal. Just to clarify - does the 14 day requirement comes from PoFA section 9 points 4 and 5?
(4)The notice must be given by—
(a)handing it to the keeper, or leaving it at a current address for service for the keeper, within the relevant period; or
(b)sending it by post to a current address for service for the keeper so that it is delivered to that address within the relevant period.
(5)The relevant period for the purposes of sub-paragraph (4) is the period of 14 days beginning with the day after that on which the specified period of parking ended.

Looks about it!Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Hi all
Just an update - we heard back from POPLA today and we won!Thank you all for your help and it just goes to reinforce the point of how parking operators are just scammers!

Well done
Please update the Popla Decisions thread announcement at the top of the forum with the name of PPC , Smart parking , decision and a link to this thread !! Thanks4 -
I am in the exact same position as you - I go to Total Fitness in Altrincham and identified you did too from the photos you provided. I don't have a ticket and I am not sure if I put in my reg at reception but the gym are very blasé about putting your details in and said to me when I joined that they would deal with any tickets. Do you recommend I appeal through POPLA? Did the gym do anything to help you?0

@ParkingFineFighter29 The OP hasn't been on the forum since 2021. Complain bitterly to your gym and remind them what they said about parking tickets when you joined. For more advice you'll need to start a new thread.2
