Argos Faulty IPAD

Hi all

 

I purchased an new IPad last week from Argos on line. This was delivered the same day. The IPad has not been preforming like I think it should and Locks up from time to time and fails to connect to the internet on occasions.

 

Log story short. I explained to Argos on web chat I wanted to return the Ipad as it was not performing to my expectations. They agreed to pick it up between 7-10. No one turned up to collect it.

 

I spoke again today to they why it was not collected. They sated that as it has been used, I cannot return it.

 

Apple can fix or replace is the only answer I keep getting from them. I have called apple they can’t even get a diagnostic of the device and have asked to go to an apple store. That is over 60 miles away, I can’t do that. 

 

What options do I have the Ipad is less than 7 days old

    Not performing to your expectations or faulty?

    If faulty, advise Argos this is why you want to return the item. Not because it is a change of mind return.

    I work in IT to me its faulty . Locking up Is not normal for an IPad. I have reset it several times and have the same issue. I have said its faulty they do not want to know .

    What do you mean by "locking up"? Do you mean it freezes, locks and can't be unlocked or something else? Re the not connecting to the internet this could be anything and probably most likely down to your own signal.

    However, having said that, Argos were who you bought it from and they should accept it back in the first instance, even just to get it checked, and if it is faulty you are entitled to a refund from them. If it's not faulty then they should return it to you and you can then contact Apple to see if they can help diagnose the problem. I suspect Argos are of the opinion that it's "user error" and that it's not down to them to deal with.
    Retired at age 56 after having "light bulb moment" due to reading MSE and its forums. Have been converted to the "budget to zero" concept and use YNAB for all monthly budgeting and long term goals.

    What options do I have the Ipad is less than 7 days old 

    You have 4 avenues really, as you have contacted the retailer within 30 days first is to reject the goods outright for a full refund, it is not taken the goods do not conform so the retailer may request you demonstrate such, typically with an independent or manufacturer report, the cost of which they should cover if found in your favour. 

    The second is to advise you are seeking a remedy under the Consumer Rights Act as the goods do not conform to the contract, within 6 months it is taken that the goods do not conform (unless otherwise demonstrated) and the retailer my offer a repair, replacement or (as less than 6 months) full refund. 

    Third is to send it Apple, (in my view only) as you've approached the retailer and they've told you to contact the manufacture this would count as their repair attempt.  

    Fourth is to cancel your contract and return the goods, Argos may refuse or impose a deduction which you would then need to fight, the information that they have provided you via durable means will depend upon whether or not you are entitled to a full refund despite the item being used.
