advice needed

i got a the most expensive controller available to buy for xbox/PC for a Christmas present,
it developed a fault 4 months after i got it, rendering it useless, but as it was a present i didn't want to hassle my brother who bought it for me to get a receipt,
so i sent it for repair under warranty instead of taking it back to the retailer and use the guarantee.

Microsoft then emailed me a shipping label in April and i sent the thingit away, i got it back in may with the exact same serial number and the exact same fault still there,
i contacted Microsoft immediately and they said "sorry, it was an error and would i like compensated with some free stuff or have free expedited shipping with multiple technical checks"@ before it was returned to me this time, i chose the latter.

at the price point it shouldn't need fixed after 4 months, but if they had done it properly the first time i wouldn't be here now.
this was on may 22 and my shipping tracking shows a crazy journey, with multiple delays including things like, "it was mis-sorted" - "held in customs" - "cleared customs but delayed" & "it's been delayed it will be ontrack asap", but that has appeared about 4 times now safe to say it's just going around in circles not far away from it's intended destination.
the last contact i had with Microsoft (will be 72 hours ago at 5pm today) they asked me to upload the receipt "if i had it" to a secure ftp server they gave me access to and to wait (again) and that they would be intouch within 72 hours.
what can i do to either get my controller or get my money back? if Microsoft don't get back to me today as promised, i really don't want to wait any longer as it is disrupting my everyday life now.

thanks for answering,it was purchased in november 2020, 4 months later it was onroute to germany for the first repair that microsoft mistakenly didnt do,so ive not had actual use of the device since it was 4months old, when saga began,, though because it was shipped twice, i'm really only referiing to the second time, where i had to sendit back again because they failed to repair it underr th3 terms of the warranty.i have power of attourney, i.m a 50year old man& im not only his brother but his primary care giver aswell, so in a sense we are 1,but i know what you mean, i'm just gathering infgormation on his behalf, trying to make sure he doesnt get straight up stolen from, i've not heard from microsoft within the 72 hours so i am going tocontact them in a sec,i kinda got the idea that you think its funny or something that i would like to end the business contract, but it's literally affecting me on a day to day basis, i woke up this morning in daze feeling compelled to check the tracking number its alli can think about as i really hate loose ends and try and find some help, as i am pretty certain that my brother and myself by extension are protecrted in some way by consumr law, but im far from an expert like you guys are,thanks again.lm0

Have you posted before on here under a different name about the same issue? Seem to recall this exact scenario not that long ago.Edit - Found it. Is this you as well?

Some posters do post the same issue more then once, sometimes under different names as they foget their login details.The dates seem to tally up, the identical opening line and a similar sign off. That's wht I thought it might have been you.
